1. Acceptance of Terms

By accessing and using KitchenEquipmentTrader.com ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Use of Service

KitchenEquipmentTrader.com is an online marketplace that connects buyers and sellers of commercial kitchen equipment. We do not own, inspect, or guarantee the equipment listed on our platform.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information when creating an account and to keep your information up to date.

4. Listing Equipment

Sellers are responsible for the accuracy of their listings, including descriptions, photos, pricing, and condition. Misrepresentation of equipment is prohibited and may result in account suspension.

5. Transactions

All transactions are conducted directly between buyers and sellers. KitchenEquipmentTrader.com is not a party to any transaction, does not process or hold payments between buyers and sellers, does not act as an escrow agent or broker, and does not guarantee the completion, safety, legality, or quality of any sale. Any agreement to purchase, payment, shipping arrangement, or dispute is solely between the buyer and the seller.

6. Fraud and Due Diligence

While we prohibit fraudulent listings and may remove them when reported, KitchenEquipmentTrader.com does not verify the identity of users, the existence, ownership, or condition of listed equipment, or the truthfulness of any listing. It is possible for a user to post a fraudulent listing or otherwise attempt to defraud another party, and you use the Service at your own risk.

Buyers and sellers are solely responsible for performing their own due diligence before entering into any transaction. This includes, without limitation: verifying the other party's identity and business credentials, inspecting equipment in person or through a trusted third party before payment, confirming ownership and condition of the equipment, using secure and traceable payment methods, and documenting the terms of the sale in writing. KitchenEquipmentTrader.com is not responsible for any loss, damage, or injury arising from fraud, misrepresentation, non-delivery, non-payment, or any other act or omission of any user of the Service.

If you believe a listing or user is fraudulent, please report it to us at admin@kitchenequipmenttrader.com. We may investigate and remove listings or suspend accounts at our sole discretion, but we are under no obligation to do so and assume no liability for acting or failing to act on any report.

7. Dealer Subscriptions

Dealer accounts are subject to monthly or annual subscription fees. Subscriptions auto-renew unless cancelled. Cancellation takes effect at the end of the current billing period.

8. Prohibited Conduct

Users may not: post fraudulent listings, harass other users, scrape or crawl the site in an automated manner, or use the platform for any illegal purpose.

9. Intellectual Property

All content on KitchenEquipmentTrader.com, excluding user-submitted listings, is the property of KitchenEquipmentTrader.com. User-submitted content remains the property of the submitter.

10. Limitation of Liability and Release

KitchenEquipmentTrader.com is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, KitchenEquipmentTrader.com, its owners, and its operators are not liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of the Service or from any transaction conducted, or attempted, between users of the platform — including, without limitation, damages resulting from fraudulent listings, misrepresentation, non-delivery of equipment, non-payment, or defective equipment.

If you have a dispute with another user, you release KitchenEquipmentTrader.com, its owners, and its operators from all claims, demands, and damages of every kind, known and unknown, arising out of or in any way connected with that dispute.

11. Indemnification

You agree to indemnify and hold harmless KitchenEquipmentTrader.com, its owners, and its operators from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your listings, your transactions with other users, or your violation of these terms.

12. Changes to Terms

We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.
